Introduction

These terms and conditions (“Terms”) apply to your use of gorilladevelopers.com and to every quote, agreement and project between you and Gorilla Developers (“we”, “us”). By using our website or accepting a quote, you agree to these Terms. A signed quote or project agreement takes priority where it differs from these Terms.

Quotes and prices

• Our packages and quotes are fixed prices for the scope described in them.
• Prices are shown excluding VAT. VAT is added where it applies.
• A quote is valid for 30 days unless it says otherwise.
• Work outside the agreed scope, such as extra pages, features or revision rounds, is quoted separately before we start it.

Payment

• Payment terms are set out in your quote, for example full payment upfront or a deposit and a final payment at launch.
• Invoices are due within 14 days unless agreed otherwise.
• We may pause work or hold back the launch while an invoice is overdue.

How projects run

• Every package includes two rounds of revisions before launch.
• You provide the content, logins and feedback we need on time. Delivery dates move if this is delayed.
• You approve the design before we build, and the finished work before we launch.

Ownership

• Once you have paid in full, you own your domain, your content and the custom code we wrote for your project.
• We keep the right to reuse general know-how, tools and components that are not specific to your project.
• Third-party software, fonts, images and services stay under their own licences.
• We may show your project in our portfolio, as described in our privacy policy.

App stores and third-party services

• Apps are published under your own Apple and Google developer accounts. Their fees are paid by you.
• Apple and Google decide whether an app is approved. We build to their guidelines and fix issues they raise, but we cannot guarantee approval or review times.
• We are not responsible for changes, outages or price changes of third-party services such as hosting, payment providers or app stores.

Hosting and care plans

• Care plans are billed monthly from your launch date.
• You can cancel a care plan at any time with 30 days' notice.
• Unused support hours do not roll over to the next month.
• Sites on a care plan may include monitoring software that reports uptime and errors to us. It does not collect your visitors' personal data.
• Without a care plan, hosting and maintenance are your responsibility after handover.

Using our website

• All content on gorilladevelopers.com, including text, graphics, the mascot and the logo, belongs to Gorilla Developers or its licensors. Do not copy it for commercial use without our written consent.
• Do not misuse the website, for example by introducing malicious code or overloading it.
• Our website may link to third-party websites. We are not responsible for their content or privacy practices.

Liability

We do our work with care and skill. To the extent the law allows, our total liability for a project is limited to the amount you paid us for that project, and we are not liable for indirect damage such as lost profit or lost data.

We are not liable for delays or failures caused by events outside our control, such as outages of third-party services, cyberattacks, natural disasters or government action.

Privacy

We handle personal data in line with the GDPR, Dutch privacy law and POPIA. Read our privacy policy for details.

Changes to these Terms

We may update these Terms from time to time. Changes apply from the moment they are published here. Projects already agreed keep the Terms that applied when the quote was accepted.

Governing law

These Terms are governed by the laws of the Netherlands. Disputes are handled by the competent court in the Netherlands, unless mandatory law says otherwise.
